I had placed my order on 29-May-2011. That included 2 Double-Bed, 2 wardrobe, 2 dining tables, 2 Sofa sets. Mr. Adil has promised to deliver the same in 30 days time, and till date not a single piece is delivered, they are always ready with excuses for the same. Please tell me what I should do to handle this. Advance was also given for the same.

Dear Sir,
I have a problem regarding a Contract which I had given Mr Santosh of Creativve for a Modular Kitchen for my house. The Contract was for Rs 258999.88 and I had to pay 50% advance which was given on the 13th of Sept 2011.I had given him a cheque for Rs 115000/- on the 13th of Sept 2011.The Kitchen was to be fixed within 25 days of Confirmationof Order and Advance. Inspite of telling Mr Santosh to set up my Kitchen for the last 4 months no action was taken siting some or the other reason and avoided setting it up. Now in and around 10th Jan 2012 he sent 25% of the Material like only the base unit like the cupboards wood cases. And he promised that he would finalise it within 4 days. then after 10days he set up the Kitchen Platform the quality of which is below standard plus the workmanship is so bad that the Kitchen Platform Granite has scratches plus the Platform is moving and the quality of wood is so bad that it has already started peeling and there are gaps between the Platform and the Wooden base below. Because even a slight pressure the granite will break.
So I do not want to continue with the contract. Because what was shown and promised to us verbally is different from what is actually given to us.
The workmanship is very below standard and the material used is also very bad and below quality than what was promised to us.
So Please advice as to how to deal with this matter as I do not want to continue with the contract but he is refusing to even meet me inspite of calling him up many times. I want my advance back of Rs115000/- which I had given to him so that I can restart my kitchen from some one else at the earliest.
