I am a Physically Handicapped person having the disability of amputation to my right leg.
2. First I should thank you for providing a separate Disabled Coach for exclusive Disabled persons. But regularly in this Coach normal passengers are boarding and not allowing the Disabled persons neither to sit nor to board the train. The Railway Authorities is failed in Implementation part of separate coach. Though there is a penalty of Rs. 500/- for boarding non disabled persons into Disabled Coach, no TTE is visiting to this Coach to implement the same. If anybody want to travel without ticket the Disabled Coach is the safest Coach to travel.
3. My personal experience is that I have travelled by 7050 on 23rd October 2010 from Secunderabad to Kazipet in Disabled Coach. The coach was already filled with the normal passengers. The disabled persons were about 8 members. The two normal passengers viz. DuvvaVenkatRaju and other usedunparliamentary language about Disabled persons. I taken objection for the words used. The train was just left the platform. The quarrel in hot. The normal passengers were manhandled me though I am a disabled person. For the help I pulled the chain. The train was stopped and the RPF personnel on guard arrived the spot. They taken me to the custody for doing Alarm Chain Pulling (ACP) alongwith the above 2 persons and handover us atKazipet Rly Stn.( RPF Station). The time was 2.00 AM (night) the SI (P. Maharaju) was really in good sleep. Being the local persons, the Normal Passengers (VenkatRaju) brought recommendation from local RPF police personnel. As such he was made free and I was booked under Section 141 of Railway Act, for ACP. I requested the SI that I have not pulled the chain intentiontionally but for need of help, but he told that if I speak more he will register the case under 3 to 4 sections so that I should be remanded. At last atabout 3.00 AM he registered the case under section 141 of ACP and collected the bail amount of Rs.1000/- and freed me to attend to the Court on 26th October, 2010. Being the section 141 petty case I was not given any chance to pray before the judge.Normal passengers travellingin Disabled Coach resulting to petty cases on disabled passengers instead normal passengers who are wrongly travelling in disiabled coach. I was made to sit right from 9.00 AM to 2.30 PM before the Court and I was given a Receipt for amount of Rs.1000/- penalty.
Sir, My request to Railway Authorities, Ministry of Railways, Ministry of Social Justice, Hon’ble Supreme Court Judge to look into the matter regarding :
1) Steps to be taken for strict implementation of Disabled Coach meant only for disabled persons.
2) TTE should check the passengers in disabled coach regularly.
3) Disabled persons need not be forced for Escort.
4) Tickets to disabled should be issued with or without Escort so that misusing of tickets with Escort is minimized which result to income increase to Railways to the extent.
5) The disabled coach should be halt at particular placeinstead front or back to SLR Coach on platform.
6) The disabled coach location on platform should be announced in public announcing system so that the disabled passengers can reach the spot well in time.
7) The penalty imposed on non eligible passengers should be written on the coach.
