    Default No refund on cancellation - Unfair Club Mahindra terms

    Sir,

    I wish to launch a complaint regarding regressive and one-sided policies set by Club Mahindra which is used to swindle money from customers without giving them their money's worth.

    I had paid Rs. 15,564 on 12/09/2009 for Blue membership down payment. And I am paying EMI's of Rs. 3970/- from Nov-09 till date. I want to cancel the membership for personal reasons but I am told there will be no refund on cancellation as all initial EMIs go to some "Admission Fee" designed such that it will not allow for any cancellation since it covers 60% of total subscription charges.

    This was not told to me at the time of sale and neither were the terms and conditions given to me inspite of me asking for those. I have not utilised a single holiday till date. Then why is no money refunded to me in that case? Atleast part of the money should be refunded and the other part covered via holidays.

    This is totally one sided and not a fair deal and I can not think of the possibility of just losing Rs. 50000/- to these people for NOTHING in return.

    How is this fair??? I feel I have been cheated big time.

    Since past 4 months they have not given any response to my emails. It is sad to see that even big companies are resorting to such activities.

    Please let me know how I can proceed with action on this.

    Default Absurd cancellation policy of Club Mahindra

    I would like to bring to your notice the unfair cancellation policies of Club mahindra. I had signed for a Blue studio membership in July 2010 and the sales rep promised a couple of free holidays and service vouchers and such other freebies used as a sales tactic to blind the customer. However at no point during the sales pitch was i ever spoken about the absurd cancellation policy( refund only given if cancellation is within 10 days). i was told my membership would start from Feb 2012 and in the meanwhile i could use the free holiday packages offered as part of the deal.
    i made a down payment of Rs16031 and agreed on the auto debit of EMIs thru my credit card. subsequenty i did pay one EMI of Rs 12023 in September 2010. In October when we planned to utilise our free holidays, did i get to know that there was no room availaibility in the resorts of my choice and to our dismay we realised that the membership was not worth it and we decided to cancel it.
    After sending an email to feedback@clubmahindra.com, all i received was auto generated mails. Couple of days later a gentleman called and said that he would like to meet us in person to help us change our mind but he never came. My repeat mail also received auto generated emails.
    Somedays later a gentleman called and said that i could cancel my membership but i will not get any refund. i argued with him that the 10 day cancellation policy was mentioned in the papers which i received 20 days after signing up. i even asked him to forfiet the downpayment and atleast pay me back my EMI which he flatly refused and said that i could go and complain wherever i wanted but i wouldnt get any money back.
    i have not used a single service/holiday from them...why should i let go of my hard earned money because of their absurd cancellation policies. this is clearly a wonderful way to cheat people and make money.
    would request the concerned to kindly help me get atleast some of my money back

    Default Bad response from Club Mahindra local agent....

    Hi,

    I have been a member for a Red season with Studio Apt, since 1st May, 2009. I have been paying my EMIs regularily without fail. It had been 6787 till this july. I have placed a request during june (nearly the same period) to change my bank from Stanchart to HDFC as my salary account changed accordingly. I was suggested by your local agent that, I can pay more EMI to close it off early and I was happy to do so. As a result, the EMI has been revised to 11495. The month for which I have give a PDC was submitted to HDFC by your local guys and it got cleared. Since then, for the next 3 months, the EMI wasn't either deducted from either the Stanchart which was the old one or from HDFC which is the new one. When I tried to book a holiday last month or in October, I came to know that the EMI are not being deducted. My holiday request was rejected saying that I have undue payments. How should it be my fault? Had your request come to my bank and it got rejected would subject to my fault. I had repeatedly, asked your guys to shift it to my new bank and was finally done, I had also been requesting them to extend the duration of the EMIs by 3 months for that undue balance. I did not get any response from your guys at all. In between, I have sent a complaint to your customer service but, was surprised by the poor response by them too. Now, at least ge this resolved!
