I had purchased a two wheeler from OSL Bajaj show room at P A S Road, Kolkata and accordingly their direction it is financed by Bajaj Auto Finance Limited ( BAFL).
At the instruction of BAFL I had signed a loan agreement Rs.23000/- & deposited 12 post dated cheques @ Rs.2051/- per month.
BAFL informed me to deduct the EMI w.e.f 08/08/2010 by way of sending post dated cheque on 8th of every month.
But unfortunately I observed that they failed to lodge my cheque on 8th Aug’2010 and
After a few days (12th Aug’10 or 13Th Aug ’10) some one of BAFL intimated me that my cheque was returned due to insufficient fund.
Immediately I discussed the matter to customer care BAFL that “NO CHEQUE has been PRESENTED in my account for collection of EMI and I am maintaining sufficient balance to honor my commitment.” And my bank account statement does not reflect any returnment of cheque.
Then they started threaten to snatch my vehicle.
I intimated the matter over telephone to BAFL AJC Bose Rd. Office about the fact.

Again unfortunately I observed that they failed to lodge my 2nd cheque on 8th Sept’2010.
Immediately I informed over telephone to customer care & again AJC Bose Rd. Kolkata office.
I send 9 letters through E mail with details of my irregularities.
Lastly after long follow up BAFL presented my first EMI cheque on 17.09.2010 & there after regularly on 8th for Oct’10 & Nov’10.
Now BAFL asking for Aug’10 EMI through cash.
Since I have given the BAFL 12 cheques for EMI and they failed to present on due date at 8Th Aug’10 how they asked for further money in cash. When it is not presented in my account how they are telling that it was returned on financial ground.
Although I have given them letter through Email to return my cheque to me & then only I will pay cash against such EMI but they are not willing to return my cheque.
Customer care promises me to short out my problem with in 5 days in the month of Sept’10 & Mrs Ahuja Manager finance promises me to short out my problem with in 2day in the month of Sept’10. But till date they have not given a single reply.
Now I received one letter from ADVOCATE of BAFL with the following threats
1) For Aug’10 my due is Rs.2901/- with penalty.
2) They will file Criminal & Civil case against me,
3) Liable under NIAct sec,138
4) Punished under sec403,406,417,420,421,422 of IPC
