I had applied for plot purchase loan with HDFC in the month of February'11. The loan amount was 8Lakhs and I had paid the processing fee of Rs.4500/- in full along with all the property documents. However due to some reasons I could not finalize on the plot and I had taken all the property related documents from the bank. At that time the bank executive agreed to consider the same processing fee if I could finalize on another plot.
Now when I went with papers of another plot, the same executive is telling that HDFC will not finance for the plot purchase and will only for house construction. When I asked how they processed the last one, he came out with another answer that HDFC will not finance for properties with 'B' Khatha. For the record I have zeroed in on a Govt. Sanctioned society site with DC conversion.
I don't have problems with HDFC not financing such plot purchase. But, when I asked the executive to refund the processing fee back, he is telling that its a one time payment and can't be refunded. When I have not taken the loan from the bank, where is the question of processing the loan and fee for that. I also told him if any legal and plot inspection is done for the previous plot, they deduct the appropriate amount and refund the rest. The bank executive is not agreeing for any of my requests.
Please let me know, whether I can approach the consumer court for such issues.
