Money given to someone but he is not returning back to me?

hi i am from Punjab.,
some of my known person has taken money rs. 100000 from me in good faith when he was in problem. Against this he has given me 6 cheques of rs.15000 each as installments. he has also signed the agreement where he has mentioned that he has borrowed the money and will return back in installments. now he is refusing to pay back. pls let me know what i have to do. if i proceed this case to court... will court ask me about money lending licence.

pls advise me how i can get money back from this person as early as possible.
