I need your help in trying to sort out this problem.
8 years ago I made a loan of 10 Lakhs to a private company as fixed deposit at 10% annual interest. Until 6 moths ago they had paid the interest regularly.They have stopped that now. Since I was not earning interest and no explanation was given I asked that my 10 Lakhs capital be returned. This they have refused to do on some pretext or other, claiming they are short of money. I know for a fact that they are doing well and not at all short of money. I have written to them repeatedly asking for return of the money but to no avail. What do I do in the circumstances? I know I can proceed to court but this will take a long time and in the meantime I will have neither the interest or my capital. Also, the company is registered in another state from where I live. Can I register a case against the company from the state where I live? This will save me the additional bother, time and expenses were I to instead to lodge the case in the state where the company is.
( I have a written statement from the company that they have borrowed the money from me as fixed deposit at a certain annual interest rate and the name of my nominees )
So in summary I will like to know:
1. What are my chances of retrieving my capital? I am even willing to forfeit the interest.
2. Can I lodge the complaint from my state instead of the state where the company is?
3. What other measures should I adopt?
4. Can someone suggest a step by step procedure of actions I should take to retrieve my money?
Every suggestion and advice will be highly valued and appreciated.
