Thumbs down HDFC Ergo Car Insurance

I have given my accent car DL 3C BP 2892 purchased in july'2010 for small accidental job work to Koncept Hyundai. The HDFC Ergo survey was delayed more than the expected time. I was chasing Koncept Hyundai team to know the estimate and to check the status of survey for 14 days continuously. Nor the HDFC Ergo intimated me about the estimate and approval on the claim. Now, I got the shock of my life today when I got a call today that the bill is Rs.75000 and claim approved is Rs.39000 and rest Rs36000 I have to pay for taking my car back.
HDFC Ergo cheats and involved with many of the service station to make money by putting the maximum burden on the accidental victim. Billing done on Maximum Retail Price instead Market Operating Price.
No one is bothered to tell the estimate before starting the work.
Insurance company and service centre has already made their own share of money and I am not able to take my car back home as I have to pay Rs.39000 after paying the maximum premium on 1.5 year old car.
Depriciation charges+so many hidden charges all comes to the insurer.
I am feeling like cheated and trapped.
Is there is any penalty on Insurance company who do not intimate their customer about the right price and right claim before starting the job work or everything is covered under their strong terms and conditions which leaves no scope for consumer to sue them for irresponsible behavior.

    Dear Mr Laviral,
As per IRDA guidelines after the reporting of loss to insurance company, survey of accidental vehicle has to be carried out by the insurance company within 72 hrs, in case of breach of guidelines they liable for penalty. For the difference of amount between what has been billed by the workshop and what you have got from insurance, you have every right to get the survey report from insurance company. On receiving the survey report you may send the copy of that report to me so that I could further help or advice you on the matter. However keep in mind while paying the loss insurance companies as per terms and conditions of the policy do not pay for consumable items besides depreciation that is 50% on plastic rubber or nylon parts and variable depreciation applicable to metal parts, in accordance with the age of the vehicle.
You may contact me for further help or advise at my mail id Adv.sunjayaurora@gmail.com or 8527569091
    Thanks
