Default CREDIT CARD (ICICI BANK) Fraud Transaction

FOLLOWING IS THE REPLY FORM ICICI BANK

    Dear Mr. Veerappan,

Thank you for writing to us.

We have an exclusive investigation team which looks into the dispute-related complaints. As per the investigation, this dispute has been resolved in favour of the bank.

The signature is not the only valid parameter to resolve disputes. We have other parameters to decide on transaction disputes which we would be unable to disclose.

A card holder is responsible for the physical security of the card. In the case of loss/theft, or if the credit card is misused, the card holder is liable for all the transactions done on the card till the bank is informed of the loss/theft.

We look forward to more opportunities to be of service to you.

    Sincerely,

    Ninad Sawant

    MY REPLY TO THEM

    Dear Sir,

With ref to tailed mail, Refer the attached scan copy of Merchant slip forwarded by you, where the name of the card holder is R Gowtham but the name of the actual card holder(your customer) is myself A Veerappan.

Secondly, the card was in my possession on the day of transaction(16th October 2011) and it was a working day for me.Since 17th of Oct was local TN election holiday, supporting the same in-time and out-time register copy signed by me was handed over to the investigated person( Mr.Guru).

Moreover immediately i intimated the call center and as per the instruction given to me i have also faxed saying "i have not made any such transaction for Rs 50,000/-".

In my 12th November 2011 credit card statement amount Rs.50000/- has been shown as credit. Thus i paid the balance amount to the bank.

But, 12th December 2011 credit card statement once again the amount Rs 50,000/- is shown as Debit.

Moreover when i inquired the investigated person Mr.Guru he told me the card has been taped at Pallikarani HP petrol bunk and it was also in bank black list point for card taping. Thus to confirm once again from my side as loyal customer i have not even once defaulted in my card payment and i am holding the same for very long time.

Thus i have not authorized this transaction of Rs 50000/- and it has not happened in my name, more over the first transaction for Rs 100000/- has got declined at 12.26.25. and immediately 12.26.51the same has been swiped for Rs 50,000/- . Thus, after the immediate SMS alert i have informed the bank that i have not done any such transaction. The call which i have made is from Chennai land line that too from office line.

Further my understating say that such a worst customer protection even after immediate intimation to bank i wonder since your are not able to track the fraud-ed person. In call the center the information i got was bank was not able to located the person who did the transaction more over fraud driving license has been provided (F/TN/004/073639/2001),more over the address given was also no such person is available, what it say as your customer i am very much available. That doesn't mean that i have to pay for a transaction which i have not authorized and done.

Now since i have not made this transaction i will not be making this payment. Leaving this amount i have made the payment for Rs 6234/-though cheque.( Six thousand two hundred and thirty four only)More over i have lodged a complaint with Commissioner of Police, Chennai, Egmore.

All my personal and profession work is getting distracted because of this issue.

    Default credit card fraud

I hold ICICI credit card (no.4477 4735 3940 9008) for about 7 to 8 years. I always receive messages every time I use my credit card. On 16th October 2011 (Sunday), in the afternoon around 12.20p.m., I received a message in my mobile from the ICICI Bank that my card was used for Rs.50000. I was shocked because on that day at that time I was at home with my family. As soon as got the message, I received a call in BSNL number in my residence (04424582006) saying that he is Ajith from ICICI and I can ignore the message sent due to technical fault. The accent was like a north Indian. In spite of it, I called ICICI bank customer care and lodged a complaint informing that the card was not used by me. They informed that the card was used in Alukkas Wedding, Kumbakonam. I called the jewellery shop immediately and they confirmed that the card was not used. In the mean time ICICI Bank sent a message at 12.27 p.m. that the transaction was withheld due to security reasons and another message stating that my card was blocked. All these happened within a time interval of 7 to 10 minutes.

ICICI did not reverse the amount till the end of November but whenever I called they said they will do it later. In the meantime a person from the legal wing of ICICI came and enquired about the details and said that it will be reversed and it got reversed in the November statement (Proof attached). He also advised me to lodge a police complaint. Since the amount was reversed in the statement I did not complain immediately. But to my dismay, on 13th December 2011, I received this month’s (December) statement which shows that I have to pay Rs.50000. (Total Amount Due is Rs.50000). I called ICICI customer care immediately and they said I need not pay and ignore the message and it will be reversed before February 2012. Again today I received a message in my mobile that the amount due is Rs.50000 and my statement is sent via e mail too. When I called them today they say that I have to pay otherwise interest amount will be added for not paying. I was a credit card holder for the past 8 years at least and I have never kept any amount due till date.

Getting the statement to make payment for the amount I did not use, gives me mental stress. They give different information at different times. If I had not called ICICI customer care today, I would not bring action even today thinking that the amount will be reversed in future.

All my calls were from my residence phone (BSNL). I am bringing the incidence to your kind notice and for necessary action against ICICI bank, credit card division.

To my astonishment, the fraud happened [B]on the same day for the same amount!!!

I delayed in approaching the forum because of the favorable answer from the ICICI customer care. The legal person also said it will be taken care of
