The Respected Registrar,
District Consumer Court, , Kasturba Gandhi Marg Barracks,
New Delhi,
Subject: Petition against Indian Airlines, Delhi against their deficiency in service and loss of my baggage Regarding.
Respected Sir,
On the subject matter it is said that I had travelled by Indian Airline flight no IC7815 on 15-5-2010 from Delhi to Amritsar. As per procedure I had deposited my luggage (Two Trolley Bags) at Palam airport Delhi (Domestic). On reaching Amritsar I found that my one bag booking no JC-159738 of grey color has not been reached at Amritsar Airport. The matter was put in the knowledge of the concerned staff of the Amritsar Air port. They had noted and had prepared the necessary papers for the lost luggage (copy of the same enclosed). On returning back to Delhi I had requested the Airline’s lost baggage unit for location of my luggage or settlement of claim. The Airlines vide their letter dated 7-7-2010 had apologized for the inconvenience cause to me on that account and requested me to provide them the details of items contained in the lost bag along with the cost of the same. The same was provided by me vide my letter dated 21-7-2010. Copy of the same is enclosed for ready reference.
The total cost of the lost luggage assessed by me was Rs 22050 but the Indian Airlines vide their letter dated 30-7-2010, had intimated me that they are ready to pay RS 6750 only. Vide my letter dated 23-08-2010, I had informed to the Airlines that the amount i.e Rs 6750 offered, is not acceptable to me however I am ready to negotiate to Rs 20000 keeping in view the delay and further bother at the end of the Airlines and said that no amount less than this, is acceptable to me. In this regard I had also talked over phone to Shri Bisht, the Assistant manager of lost baggage unit of the Indian Airlines who had said that as per their norms for settlement of claims, they could offer only upto Rs 7750 maximum. As per details of lost baggage , I have suffered a loss of Rs 22050 but airlines is offering me only Rs 7750 (maximum) which is far less amount than the loss I have suffered. It is also not out of place to mention that on loss of my baggage, I had spent Rs 8000 immediately on purchase of dresses of my kids which were required urgently, since all their dress had been lost in above said incidence.
In view of above, it is humbly requested to direct airlines to pay me Rs 22050(actual loss) and Rs 20000 as compensation for botheration I have met on account of Airline’s this deficiency and negligence in services.
Yours sincerely,
Ek Dass
