History of Complaint:

I was sold a Datacard Connection No. 9351062806, the USB costing Rs.2600.00 in the month of April, 2009 the performance of which was not satisfactory. When I complained I was suggested to buy a HSD Coonection with an assurance that my Datacard Connection shall be sold at Rs.1000.00 to a customer requiring after adjusting the scheme prevailing. It has not been sold for and my investment is blocked. I was sold HSD Connection at Rs.3300.00. I required the connection at my residence at Vigyan Nagat, the area is not covered by the Reliance Tower and receives, weak signal. The fact was known to the Management of Reliance Store at situated at 5-A-8 G Zone, Talwandi, Kota, who Wrongly sold both abovementioned connections to me. This resulted in my receiving 2 Wrong Billings of Rs.2130.00 and Rs.2104.00 on my representation a waiver of around 1026& Rs.915.00 in each of the two bills was given still the amount was around Rs.400.00 higher than the normal plan i.e. more than 50 %. Mr. Anusuman, their dealing officer I met in connection to my complaint he asked me to deposit the bills and he shall arrange to give me waivers under his discretionary powers. I could get only one waiver amounting to Rs.110.00 on 2nd February, 2010. There after Mr. Anuman was on leave for a long time and subsequently resigned from his job also.

I had lodged complaints online as well as at the local office, which have so far never been attended.

My Plea: Sir,

I am a senior citizen and handicapped also because of an injury to my arm I suffered extensive losses and am living in a Gurudwara because I do not have my own residence. I am carrying on my freelancing services on he internet and a good internet connecton is my necessity and right also. I have been made to suffer by selling me a Connnecton, for which Reliance have no service in the area. Twice m connection has been disconnected, whereas I have always been depositing the bills in time. I was forced to paid the overcharged bill amounts.

My Losses:

My balance amount of Rs.668.00 on account of wrong billing is still pending.

The wrongly sold HSD connection was not receiving signals in my premises and I had to go to a park to get the signals and do my work. I have suffered loss on account of my amount of HDS & Datacard USB total amounting to Rs.4300.00.

A sum of Rs.50.00 levied penalty on account late fee is to be reverses, since the Rs.100.00 on which Rs.50.00 was charged has already been reversed.

I requested for closure of my connection with effect from 7th pf June, 2010 the Reliance Store has collected from me additional charges for 7 days. Which is unjustified.

I estimate a loss of Rs.1,00,000.00 on account of financial loss and inconvenience caused.

Sequence of Events of complaint

1. I had purchased a Reliance Data Card Connection No.9351062806 by paying Rs.2600.00 with 2 months free internet access. After using this connection I lost two of my projects because I got a translation job and even after running the data card for full night I failed to down load a Voice Message on the basis of which I had to complete the translation.
2. In one more instance I was not in a position to view a video online, which contained the instructions for doing the project. Thus I lost two of my projects because the connection did not worked well in my premises at Singh Sabha Gurudwara, Vigyan Nagar, Kota.
3. I went with my complaint to the Reliance Hub situated at 5-A-8 G Zone, Talwandi, Kota, where I was suggested to buy HSD connection and I was told that they shall dispose off the DATA card USB to a customer, which so far has not been done even in spite of many reminders.
4. Acting on the Suggestion I purchased HSD connection No.9352333193 for Rs.3300.00 on an assurance and belief that my abovementioned DATA Card connection shall be sold for Rs.1000.00 after adjusting the 2 months free internet availed by me.
5. Above HSD Connection was also not performing with good speed. My first bill for few days was Rs.231.28 I did not care about it’s correctness and paid it.
6. I was shocked to receive my second bill of Rs.2130.00, which was due to malfunctioning of the HSD connection signals to my connection every now and then the signal was received and automatically disappeared and appeared multiple times in my operation. Every time the signal break and reconnection my mb using was getting added up. My bill of the previous month states my connection limit as Rs.1600.00 it is surprising how they allowed the amount to jump to Rs.2130.00. I had disputed the bill and I suffered about 7 days disconnection of my service.
7. I received a wrong billing and I suffered due to disconnection. I was advised to pay Rs.1100.00 by Mr. Anusuman dealing officer at Kota office and assured me to adjust the difference amount by waiver of Charges @ Rs.100.00 per month believing on what was proposed to me I deposited Rs.1100.00.
8. Next month I again received a Bill of Rs.2014.00, which I brought to the Notice of Mr. Anusuman, who asked me again to deposit Rs.1100.00 for this bill and he shall be adjusting Rs.100.00 per month for both the bills.
9. When I reminded Mr. Anusuman about the due waiver of Rs.100.00 he had assured me, he advised me on phone conversation to deposit Rs.100.00 less while making the payment.
10. Thus when Rs.100.00 was less deposited in the bill, because of the arrears, a penalty of Rs.50.00 was imposed and my connection got disconnected. I had to deposit Rs.10.00 for reconnection of the service.
11. Mr. Anusuman had been on leave due to marriage. My first Rs.100 + (10 deposited by me cash as reconnection fee) was adjusted on 2nd February, 2010 reflected in my statement of Account.
12. Rs.50.00 penalty levied for no fault of mine is yet to be adjusted.
13. Mr. Anusuman told me during my last conversion with him, said that the entire difference of over billing now shall be cleared in two waivers around Rs.350.00 each.
14. Mr. Anusuman has resigned from his job and my over billing amount is yet to be adjusted.
15. I had many times complained to Reliance office at Kota as well as at their toll free number but during the entire one year period no body visited to attend to my complaint of no signals some time and automatically logging on and off each time consuming additional mb usage in my account, which was responsible for my above stated wrong billings.
16. During the last few months their signals were not at all were received at the premises, where I was operating the connection. I had to go out to a park to get the very weak signals.
17. I met one of Reliance official personally and after many reminders one person visited me and converted my HSD connection in Hybrid mode, which means if HSD connection is not there my system shall receive data card signals (very less speed), and when HSD signal is there it shall switch over to HSD resulting into frequent switching over from one mode to another mode and every time consuming mb usage moreover it became a nuisance to operate the connection the Reliance installed and activated.
18. I have expressed my complaints but no one is ready to attend to the complaint because nothing can be done.

You shall find from above that I am a victim of over billing.

I was compelled to pay the exaggerated bill amounts Rs.1100 instead of Rs,725 of each bill.

The levy of Rs.50.00 on Rs.100.00 arrear is unjustified and has not been adjusted.

Having fed up I had to get the connection closed on 7th June, 2010, even in spite of my written request to close the connection with immediate effect, Reliance has collected from me 7 days extra charges instead of up to 7th of June, 2010.

Reliance has wrongly sold me HSD connection No. 9352333193 for which Reliance has no tower coverage in the locality of Vigyan Nagar where the connection is installed after my complaint with my data card connection No. 9351062806.

After conversion to Hybrid Mode the speed is of the Coonection has been reduced to that of Datacard, which I in the beginning purchased and was not satisfied with the performance.

My investment in HSD USB device Rs.3300 and Datacard USB Rs.2600 is held up, which Reliance should take back because of wrongly selling me the HSD connection.

Once My connection was disconnected for 7 days, when due to wrong billing the amount wasRs.2130.00 Instead of Rs.725.00 much before the billing cycle due date.

Second time my connection was disconnected when as per advice of Mr. Annusuman looking after Kota region advised me to deposit rs.100.00 less.

Levying of Rs.50.00 penalty on disputed amount of Rs.100.00 is not appropriate. Moreover all my bills have been paid before the due date. Levy of Rs.50.00 and resulting disconnection of my service for 2 days is uncalled for causing me loss and inconvenience.

Because of HSD Connection not functioning properly and twice suffered unjustified disconnections I suffered lot of inconvenience as well as loss to my freelancing services I am rendering to my clients, which I estimate worth Rs.1,00,000.00.

I am lodging this complaint to the Consumer Court to look into the damages caused to me by:

1. Selling me HSD Connection, for which Reliance do not have any service in the locality of Vigyan Nagar, Kota, Rajasthan.
2. Not attending to my complaints.
3. Not settling the wrong billing issue.
4. Disconnecting my internet services twice.
5. Levying of Rs.50.00 penalty, whereas I have the record of depositing all my bills before time. Rs.50.00 is yet to be reversed though Rs.100.00 due to which this Rs.50.00 has been levied was reversed.
6. Having fed up with the services I requested closure of my connection with immediate effect and Reliance has charged for additional one week.

I request please consider the damages and inconvenience caused to me by reliance because of faulty selling and insufficient servicing provided to me.
I declare all the above stated facts are true facts, the responded has failed to act in the justified manner causing me loss and inconvenience, which the respondent is liable to compensate.
