This complaint is regarding negligent and callous treatment by Dr Shouvik Deb(Surgeon) of MGM Hospital & Research Centre,CBD Belapur,Navi Mumbai - 400614.I had gone there for treatment of my right leg (i was suffering from eczema about which i came to know later),the doctor prescribed me medicine and ointment without fully understanding the disease ,which in result aggravated my disease and reacted badly .Finally after wasting my money and time (for at least one week i had gone through trauma and suffering) that too in the third visit he referred me to dermatologist in the same hospital.

After that i visited to another hospital Jairaj Nursing Home where i consulted Dr Kiran V Godse who prescibed me the proper medicine which cured me within 2 days.

So MGM Hospital which portrays itself as a Non profit Institution is totally misguiding (as they overcharge the patients) and false.Also they are defaming a noble profession and are playing with human lives and breaking the trust between the patient and doctor profession.

So i request you to please take any action so that innocent people don't suffer there.

My wife aged 46 years had to undergo a surgery TAH+DISECTION OF LYMPHNODES of pelvic area on 09-02-2009 under Dr.(Prof.)S.Mishra MD. FICOG in kolkata.After the surgery she started to suffer from acidity,gas, chest and abdominal pain and infection of urinary tract. Inspite oftaking medicines as advised by the doctor, her problems continued.On 27-04-2010 USG of whole abdomen and IVP test shows right renal hydronephrosis likely due to a non opaque mass of obstruction. On30-04-10 and again on 29-07-10 URS+Rt PUSH+DJ ESWL +CYSTO+ RGP done twice under Dr,S.K. SINGH, MD FRCS Urologist at Patna (as we have shifted to patna from kolkata). But, the problem became more acute with other ailments. I had to rush to Chennai with her. There, on DTPA (Diuretic Renal Scan) it has been revealed that her right kidney is functioning only by 26% and the blockade in right ureter is due to a 3.5 cm stricture which was occoured at the time of TAH+BSO+Pelvic lymphodentery done at kolkata by Dr, S. MISHRA ON 09-02-09. tHE PERMANENT LOSS OF RIGHT KIDNEY which is functioning only by 26% is also the result of the mistake done by the doctor. What actions should be taken against the errant doctor ?

You should file a complaint in the State Commission for Consumer Disputes.

1) Collect all relevant case papers and arrange in correct order. Make copies and keep files ready.
2) Write down the facts of the case - chronologically. Do not get emotional. Just stick to facts.
3) Get a doctor who is an expert in these cases or the doctor who discovered the cause of the problem to give a written opinion on the condition of your wife. This opinion should be duly notarised.
4) With all the above file a consumer complaint and ask for compensation for negligence.
You need a very good lawyer because it is difficult to prove negligence.

Error or lack of skill is not negligence. But a good lawyer with all the facts and supportings can argue that it is negligence and you have a good chance of winning it.

You may have to file the case in the state where the incident occured. Do write to Medical Council of India regarding the mistakes made by the doctor with the items mentioned in 1,2,3 even if you decide not to file a case. They will investigate and take action against the doctor internally.
