Dear Sir,

Even though i am writing this complaint but i dont know how a middle class common man can fight against the menace of a builder. In India, where builder can do anything and get away by bribing a few corrupted people, its the consumer who at the end is to suffer.

I bought a flat in KIRAN TOWER, Malad in August 2008 where at the time of seeing the flat, i was told that the possesion is in December 2008. The building was almost 8 floors ready at that time and i was told its a 12 floor building. As the rate was pretty reasonable and since i was an employee, i wanted to take benfit on tax and pay EMI from my salary, i agreed to pay the token of Rs 100,000. AFter a couple of days when the agreement was shown to me the date of possession was mentioned in the contract as Dec 2009. My objection held no meaning as cancelling the contract at that time would have costed me the token amount and so i went ahead with the contract (completely my mistake here). Since, i was unmarried and had a good job, i was ready to wait for a year. But to my absolute shock, even in December 2009, the building was far from complete. The builder said that he has applied for additional 2 floors and he will making 14 floors. This time was also start of recession period, where i lost my job as well.

As of today when i am writing you this email, the builder, Mr Kiran keeps giving me false promises that it will take additional 2 months....This promise has been made more than 5 times. When i told him that i need this in writing, he keeps telling me that he will courier me the written letter which has never reached me. The builder keeps threatening me that i can go to police or court wherever i want. I have approached Malad police station and told them about this matter where they told me that they cant be of any such help because its the consumer court that can help people like us.

I want to know is there some justice where builders like this are punished and people like us get some solution. I am married now and am staying with great difficulty with my parents. I have borrowed money from my friends and colleagues to pay my EMI's and have no clue what will happen if such thing continues for even more 3 months.

I would be extremely obliged if you can help me with a proper solution where i should also be compensated for the time i have suffered due to this builder, Kiran Asher.
