With due respect, I want to mention you something about the current problems arising for the residents or flat owners in the residential colony now a-days not only in Bangalore but also in several metro cities .
I am a resident of 'National games village',karomangala, Bangalore'. It is a very beautiful colony more than three thousand flats have been made.There are twelve blocks .Each block consists of more than two hundred flats.There is a beautiful park in the colony. Each block has it's own managing committee or association as well as a federation is there to look after the problem of the whole colony. Even Karnataka housing board office is there to look after all physical problems of the colony.There is no strict law and order is followed.The shop keepers who are sailing goods,never give proper reciepts the tailors take orders and do not deliver the things properly. A number of security men have been appointed in the main gate and back gate. There are a number of security men in each block still then many wrong things happen. Both girls and boys together stay on rent as hostel accomodation in various flats.
Even the security do not guard the n.g.v park so strictly.The youngsters are not only the local teenagers but also, are from outside states.Youngsters used to conduct many wrong things and offences as there is no strict law and order followed in the park.Youngsters smoke ciggarrate and drugs in some shops. Many outsiders are accessing into the colony during late night.There is no restriction or prohibition for them to move freely around the block during night time in the residential colony creating offences. Many bank officers from various banks,government officers, engineers are staying over the colony. How will they protest such thing? If they donot protest such thing then what will be the future of the city?
Previously Karnataka housing board was looking after the maintenance of all blocks of national games village. K.H.B was responsible for the maintenance of security and law and order of the colony. Now the situation is different. Associations are executing their own bye-laws, following the association's bye-laws act, which has been approved by the magistrate. All well fare associations of N.G.V comes under the jurisdiction of Karnataka apartments ownership act 1975 and 1972..According to the act, certain rules are mandatory being based on democratic principles like,[1- election,2-- presentation of annual budget in general body meeting which exceeds more than six lakhs ,submission of financial/audited reports for approval in A.G.M. 3--Office bearers must take the approval of expenditure more than fifty thousand.] Various banks and central government have taken possession over their own property which is maintained by the owners association. The question arises whether Karnataka housing board has transferred it's power to all the blocks of National games village or not? If the associations are registered body then, they must exercise certain power over the blocks. If any flat owner or bank quarter or government quarter goes through major repairment work like renovating the flat, must take the permission of associations. If it causes damage and financial loss to the building, then that flat owner must be declared as defaulter. In such case, what legal remedy the owner's association should take? Can the association use it's power suiting or lodging a case in consumer court or in consumer dispute redressal forum against the flat owner? Many flat owners have taken it for granted by doing majore repairment work like remodelling, renovating their flats even breaking the combined or joint balcony wall, which definitely can weaken the common building outside balcony wall, which is a common property of all owners association. They can suit or file a case in consumer court following certain legal right.
I think all the associations together can form a very strong, powerful, federation representing a few members from each block as well as from each field like bank,government office and owner who can get the legal disputes solved and other development work done quickly for the residents of national games village. Some of the efficient development work like construction of a boundary wall around the N.G.V colony can be done properly. But my question is, why should we go through K.H.B now ? Every month for the supply of Cauvery water and other common facilities like maintenance of park, road, security, street lights etc, associations can directly pay money to B.W.S.S
The NGV colony itself has been declared as an individual ward more than 4000 people are staying over here. So the common facilities of the area maintenance comes under the jurisdiction of Karnataka urban development authority and Bangalore mahanagar palika. Regarding the park maintenance, it is a public park now. Another essential amenity is security which comes under individual block or section. All these things can be settled through mutual discussion by forming a strong and active federation taking members or representatives from various fields like banks,government office and other owners.Then only uniformity, justice and truly efficient wellfare work can be done.
