I had booked my first flat from Ansals in Sl3 Gurgaon which they promised to give in 3-4 years time.
After 11 years they gave me a delapidated,worn out flat which had been given to their staff to stay in.
Now they are charging hefty 'holding' charges for not accepting the flat in a broken used state.
They have also charged huge escalation charges.and have refused registration till all the money is paid

i have been put in the same situation by the Jai Kisan Estate, Developer of krishna apra gardens in indra puram.

I have booked the appartment in 2005 by paying 90% amount as cash down through Bank finance ICICI Bank. they promised to deliver it 2006 september but actually started handing over in March - April 08 in completed blocks. my unit delivery was not informed to me and every time i visited them they advised one or two more months. this continued for the full 2008 and unitil may 2009. in may on my visit to their office they surprised me with additional charges fas penalty for not taking the possession on time. also when i asked them to show the ready flat what they showed me was poorly built, with no fittings or final works done. and they saild to me that balance works can be done on payment of balalance 10 % which i duly made and they borroed two more months to make it ready for hand over. but to my surprise again the failed to make any progress at all and advise that i need to make the registery 1st in my name. which i refused to do due to my fears that after it they may not do any works.
now for last five my months i have been sending them reminder about the pending works and finishes and to make it ready for handover but they are hardly giving any ears to my grievances. Also they have adivsed my to pay maintenace fee for the period from the date they hand over 1st apartment in the complex. i am based in abroad and they seems to be taking full advantage of the situation.
Is ther any way to teach this develepor a leeson as i am sandwitche dbetween bank and developer now. i have been serving bank's installment for five years now with no income / usage to me from the financed property.
Now so many schemes are there to lure the customers for booking units financed by banks with no EMI payments untill hand over that means developer would be bearing the cost to finance. Can i claim my interest servings to the bank from the developer for the defaulted period. And how to sue the developer for delyaing the handover of my unit.
