Dear Sir,
I Mr. Ashwini Prasad Chowdhry, bought a flat and took possession in October, 2007 in an under construction building. I have bought this flat for Rs. 10 lacs (Rupees Ten Lacs), paying monthly EMI Rs. 9275/- from November, 2007, for this I have taken loan from State Bank of India.
After few months I noticed that the pump room & electric meter room, which they were using as a godown, got transferred into covered garage and they quietly sold it off. And latter on in December, 2009, the guardroom was also sold by converting into a covered garage. I and other flat owners continuously objected to it. But, the Landlord and the Promoters somehow manage to convince all the flat owners along with me by threating, stating that if we do so he will put us into trouble. And now the open space in this building is also converted into covered garage and they are planning to sell it off.
My problem arose, when, since one year. I am trying to sell my flat, for that I floated an advertisement through website and accordingly many buyers turned up. But, the major problem came in this process was that my sanctioned plan of this building on which I have bought the flat and my loan got sanctioned from SBI, shows Meter room, Pump room, Guard room and Open space. But, visibly there is no such rooms and space. When the buyers starting questioning me on this, I have no answer and due to this no body could buy it. I also don’t have drainage and water connection papers of this building and also many other relevant papers. Which is required for the resale of a flat it is still with the Landlord and Promoters. They have not yet handed over the papers of this apartment to anyone till today.
I have verbally requested them to give me all the papers of this building. After that I issued a letter on 21st April, 2010, demanding papers of this building and also paper of installation of my electric meter. But, they gave me no reply till today.
After that, having fear in my mind. I made a complain in the Kolkata Municipal Corporation (KMC) regarding illegal construction and also in the drainage department, but nothing happened.
The Landlord after knowing all this made my life hell. He is started abusing me; everyday he is threating me and warns me I should not do anything further.
Now I am unable to stay here nor I can sell my flat. I am in a great great trouble. I am service class people. I stay with my wife and 2 years old son. Landlord has made my life miserable here.
But, I have no way-out left. I have come before you with a great hope to grant me justice. The only thing now I want is that they should give my money with interest of this flat.
If you do so, I will be highly obliged and we will very thankful.
