I had booked a flat in Enkay Garden, Wavanje village, Taloja (Navi Mumai) in June 2010. Building Lavendar - IVth Floor. Since then I had paid Rs. 2,25,000 as amount for Flat and Rs. 75000/- as Stamp Duty. I had made a payment of Appx 3,25,000 till Oct 2010. Since then I am awaiting for registration of my flat. It is more than one and half years I keep calling Enkay Garden Rep about the status of my flat. Every time they say we have not yet received the approval for IVth floor, that's why we can not proceed for registration. I even asked to allot me any other 2 BHK Flat on 1st, 2nd or 3rd Floor but they have denied it. Every time they say the same cock n bull story. When I asked for my refund Enkay Garden Executive Mr. Varghese told me to refund my whole amount but without any interest. This is to mention that when I booked the flat the Rate per Sq / Ft was 1750 whereas as on date rate quoted on Enkay website is Rs. 3000/- per Sq Ft.

The builder is increasing the rate day by day, whereas I am not even getting interest for the amount I paid to builder. At the same time it is not my fault that I am withdrawing. If clearance was not provided to Enkay Garden, why they have invited booking of flats.

Kindly guide me what should I do. Should I approach a Consumer Forum or file a case in Court.

Hi pksaw. Me nd my brother have also bo%oked 2flats. Have paid 20% down pmt but the registration is not yet done. Which wing have u booked the flat for? The builder says that the appeoval has not yet be given by the govt bcoz the township comes under gaothan. My question is wasnt the builder aware that the township was under gaothan and as per the rule u can only build upto 3 floors. Pksaw is there any way we can gather more people who booked flats there and fight against it.

Do provide me any alternative if you can. What we should do further. If something is done collectively we can go further. I do know 3-4 friends who have booked the flat in Enkay Garden.
