We had bought a 2 bhk flat in 2008 in nagpur at 13 lacs. our builder was supposed to give us possession in dec 2008 but still has not given us possession. We had financed home loan from lic.Now suddenly 1 day he sent us a letter saying that there was a difference in the proposed plan and the revised plan which is submitted to the municipal authorities and we must pay the increased difference in area (We hadn't asked him to increase the area, nor was it included in agreement) without which he is not going to give us the possession.Secondly he is now including parking area in the built up area (thus saying that total area is increased)and asking us to pay for it (The agreement already mentioned that he will be giving us the flat with share in parking area and the total cost has been mentioned in the agreement to sale as 13 lacs).His new stance that he had not charged the parking area, stair case ( which he now is counting in built up area and not super built up area) has really put us in a spot.He has sent us a letter titled" possession letter" saying that we must pay the difference amount of 97,000 before taking the possession.
Please help us to let us know whether consumer forum can help us and are what are we supposed to do in such a situation.
