I kamal Kumar Agarwal,S/o. Sri K.N.Agarwal, residing at 37, Matrumal Lohia Lane, Salkia, P.S. Maliponghora, Howrah- 711106, has booked a flat on dtd.08.05.2010, with Mr.Mahesh Kumar Sureka (Promoter) residing at 6/2/1, Ashutosh Mukherjee Lane, Salkia, Howrah- 711106, site at 36, Abhoy Guha Road, Liluah, Howrah, at Block A, Flat No.503, approx area 1000 Sq Ft. against which I paid Rs.21000.00 vide chq no. 560611 dtd.08.05.2010 drawn on SBBJ, Howrah, and then i paid Rs.30000.00 vide money reciept no. 81 dtd.19.05.10, and then i paid rs.149000.00 vide money reciept no.93 dtd.24.05.10. Total amount paid by us Rs.200000.00 and ask for Agreement of Sale Register from time to time & repeatadly told him to collect the payment but Mr.Mahesh Kumar Sureka has not taken it seriosly. And on 26.07.10 we have recieved a registered mail vide no.RLAD L 3325 dtd.23.07.10, & when i opened the envelop, i got shocked to see 2 blank papers inside, & for which i immideatly called up Mr. Sureka, but he canot attend my calls, then i immideatly make a sms & sent a email to him about this but no response has been recieved from him. Then i sent register mail with ad vide no.RLAD A 9425 & RLAD A 9426 dtd. 30.07.10 about this & requested him to collect her paymnet & give me the Agreement of Sale, but this letter has been returned to us indicating 'Left Return to Sender' & 'Refused'
but no response has been recieved from other end. In the meanwhile time we are trying him to contact Mr.Sureka through phone but my effort gone in vain. Again we sent the sms & an E-mail dtd.07.08.10 regarding this & requsted him to collect the payment & send the Agreement of Sale to me. But on 09.08.10, i recieved a email by Mr.Sureka, in which he stated us that we have not booked the flat & told us the defaulter in making payment & told me that he cancelled the booking of flat & told us take 90% of our paid money back within 15 days.I m got shocked to see this mail & I dont know what to do.
