    Default Houseing Property - Nigdi Pradhikaran

    Dear Sir / Madam

    There are four party in this Complaint

    1. Mr. Velankar : Plot Owner and Also owner of Flat no 3 (Neighbor of Mine) (Only Person staying in the said building)
    2. Mr. Patil : owner of Flat no 1 (Not staying due to problem)
    3. Saud Siddique : Builder (9822040721)
    4. Amol Repal : Myself Owner of Flat no 2 (Not staying due to problem)

    I have purchase the said Flat no builder in the month of Dec 2008 and done the agreement officially
    In the said agreement builder committed to give me pulsation till March 2009 but he has given the same in the month of Dec 2010 and that is also not as good as we consider in new flat

    Then I come to know about the Owner of the property Mr. Velankar who has done the agreement with builder and some condition which I know are as below
    1. Flat of 1200 sqft and also sum of Rs XYZ
    2. Builder will not able to give pulsation to any other till he not give pulsation to Plot owner Mr. Velankar
    Now with these reason and some personal fight with Builder and Plot owner (Mr. Velankar) the said property has not yet TRF in my name from Pradhikaran (PCNTDA) as the plot owner is not ready to sign certain documents.
    Also the plot owner (Mr. Velankar) is not allowing me to sale the said flat and creating the issue in front of my client which came to see the flat.
    The Plot owner say that the said Flat is not yet TRF to you can’t sale the same.

    When I and Mr. Patil approach to builder for the same issue as due to mental harassment from the plot owner we are unable to stay there nor we able to sale the flat, builder is just giving me the assurance.

    The said issue is pending from last 1 yrs where I lost my interest which I pay to Bank for Home loan and nor I able to give the same on rent.
    Because the plot owner is not allowing any one to stay there and client if come to see the flat as we want to sales the same.

    Now I want to sale the same flat to any party but due to this reason not able to do the same so request builder to buy back the same at current prices and give me composition.

    So now in this issue I need the help from you side and kindly suggest me what can I do for the same

    Default Deprivation of basic rights

    I, Shyama Prasad Chakraborty is lodging this complaint on behalf of my mother, who is a eighty eight year old senior citizen and ex freedom fighter.
    She is the sole resident of a rented flat at 19, Mansatala Row, Kidderpore,Kolkata 700023, West Bengal. Her landlord Mr Shyamal Sarkar whose mobile number is 9874334921 is constantly depriving her of the basic rights of a tenant by
    a) Not taking any action to fix her overflowing toilet
    b) Preventing her from taking any actions to fix it on her own initiative
    c) Refusing to give her a duplicate key of the building gate.
