    Default Leakage not attended by the Builder.

    I have purchased the flat in Lodha paradise, Majiwada, Thane in IRIS Bldg. I got the possession in March 2010. I started the furniture work from May 2011.
    In Sept.( 18th Sept ) I noticed heavy leakage from the ceiling of master bedroom. I complained to the Maintenace dept of M/S Lodha Developers. But no action was taken from their side.
    I kept complaining and wrote many letters/emails but no avail.
    When I threatened legal action, the G.M. of Lodha Devep. services wrote to me that from their side they are ready to do the job but the flat owner from whose bathroom floor the leak is happening has to give permission.
    Upon this information, I met the flatowner & impressed upon him for giving cooperation, which he agreed.
    I observed no progress hence gave time till 7th Dec. for starting the work and informing the status but no written communication has come. Their site representative keeps telling that the flat owner ( 1001 ) is delaying the permission.
    The net result is no action is taken from the Builder's side for repairs.

    I would like to approach Consumer court for damages to my flat as well as penalise psychological torchure me and my family going thro'.
    Pl advice.
