Sub : Wrong Cancellation of Allotment / Booking Without consent / Intimation

We wish to inform you that we have booked 2 Flats, 501 & 502 in Swarajya Ambivili Project developed by Neptune Developers Pvt Ltd and we had made our initial booking deposit of Rs. 22000 which was duly acknowledged by Builder vide receipt nos. 578 & 214 of Rs 11000 each dt 04/04/2009 & 29/03/2009 respectively

I had called builder office during end of Dec 09 to enquire about the payment schedule details.

I was shocked to be informed by Builder office that our booking has been cancelled due to non payment of Dues as per the payment schedule. Further, on recent investigation, we understand from Builder office that Builder has arbitrarily cancelled our allotment without our consent in writing or oral and have issued our allotment to some one else.

I wish to confirm and clarify that NEVER on any instance that we had requested Builder office for canceling our booking. This has been done arbitrarily by Builder without our consent or agreement.

I never received any intimation for the payment, we received no notice, we received no personal call or messages intimating us about the pending schedule payment.

We have already sent the request to Builder for the statsu of the 2 Flat through letter & also said that if we not get the same flat, we want our initially Deposit back of Rs 22000/- but we never get any resposn on that . Hence we request you pls look into this matter & help us for Initially deposit back.
