Dear Sir,
M/s Serenity Group, Bangalore is developing a layout in Bangalore. I have booked a site with M/s Serenity Group, Bangalore. I paid Rs 50,000.00 advance (trough cheque) for site booking amount. but the papers given by M/s Serenity Group, Bangalore to establish title of land were not sufficient. Hence, my advocate advised me to not go for this site. Accordingly, I requested M/s Serenity Group, Bangalore to return my amount of Rs 50000. But they did not returned my amount. I went to Consumer Court to get my amount.
During proceeding of the case M/s Serenity Group, Bangalore filed affidavit indicating this case does not fall under consumer protection act 1986 “SERVICES” and is beyond jurisdiction of consumer court. They appealed to dismiss the case.
SERVICES AS INDICATED IN ACT IS AS BELOW:
“SERVICE" MEANS SERVICE OF ANY DESCRIPTION WHICH IS MADE AVAILABLE TO POTENTIAL USERS AND INCLUDES THE PROVISION OF FACILITIES IN CONNECTION WITH BANKING, FINANCING, INSURANCE, TRANSPORT, PROCESSING, SUPPLY OF ELECTRICAL OR OTHER ENERGY, BOARD OR LODGING OR BOTH, 1[HOUSING CONSTRUCTION,] ENTERTAINMENT, AMUSEMENT OR THE PURVEYING OF NEWS OR OTHER INFORMATION, BUT DOES NOT INCLUDE THE RENDERING OF ANY SERVICE FREE OF CHARGE OR UNDER A CONTRACT OF PERSONAL SERVICE;
My next hearing is on 26 July 2010 for argument.
I have not hired any advocate and presenting my case myself.
Please let me know if my case is beyond jurisdiction of consumer court else please let me know how to handle this.
