Hi,

My yamaha enticer got burnt under transit 3 months back as the same was sent by my parents from Alwar (Raj.) to Mumbai where I am currently working through First Flight couriers. I am facing a lot of problem since then because of that:

1) I was denied any compensation by the First flight as they said the vehicle was not insured by them before transporting because it had an regular 2 wheeler insurance with National insurance and no insured vehicle can be insured again. (I don't know is it really true)

2) After my & my family many follow up with the insurance company, they finally agreed to pay the vehicle repair under insurance covered.

3) The Bike was delivered to me by first flight after 1.5 months of booking as it was stuck in survey because first flight said it is a total loss case which surveyor from the insurance company later denied and said it can be repaired after which i followed up many times with first flight to get the bike delivery which i got after many problems

4) I took the delivery and gave it to a workshop in Mumbai where estimate of total expense was prepared (approx 20,000) and surveyor approved it except some engine parts saying the parts are not covered.

5 After approval the yamaha workshop promised me to get the bike repair in 15 days but they took 1.5 months to do the same and day before yesterday they called me collect the bike saying the bill is of around 25,000. when I asked why it has increased by another 5,000 rupees, they said they have done some work with the engine and these were not mentioned in the estimate as when they started repairing the bike they found that bike kick was jammed (though when i gave them the bike for repair, at that time they checked in front of me and the bike started).

Now when I asked the insurer to cover the extra charges under insurance he said the same would have been covered had the workshop engineer called him at the time they were opening the engine as then he would have clicked the photos and have added one supplementary estimate with engine expense.

Please suggest what can i do as even if the insurance company pays i have to pay atleast 10,000 rs as many part are fiber on which only 50% is given by insurance company. (i want to claim this form first flight)

I want to file cases against all three i.e. first flight, insurance company and yamaha workshop as they have made me gone through a lot of troubles pls suggest??
