Dear Sir,
Under instruction from my client Mr. Devang Trivedi, resident of 4, Vidhi Row House, Nr. AXIS Bank, Opp. N Mart Store, Gangeshwar Mahadev Road, Honey Park, Adajan, Surat -395009. (Gujarat – India),. I have to address you as under through this notice on his behalf.
1. That my client doing service in Gujarat Gas Company Ltd. at Adajan, Surat.
2. That you are no. 1 and 2 are manufacturing and repairing the mobile and no. 3 is au-thorized service centre of above mentioned company. no. 4 is authorized seller of Sam-sung mobile.
3. The handset Samsung Galaxy Grand I6082 MBU INU. Bluecolour has been purchased by my Client from Mobile Shop Named M/s. Bhatia Mobile, Surat.dated28/05/2013 by this Bill No:- 602/R ,of Rs.18,800/- .
4. My Client has facing problem in related to Voice hearing & Ringing as well as Hanging of handset. He has visited Mobile seller No:-4 on 29/05/2013 , he has instructed to my Client to visit No:-3

A. But at that time, my client has out of station Bharuch for official work, for few days so he has visited No:-3 on 08/06/2013 and No:-3 has formatted Cell Phone and given cell to my client on 09/06/2013.( Job Sheet No:-4153229666)
B. Second Time again my Client Visited No:-2 and 12/06/2013 and same thing happened.
C. Third Time My Client Visited on 18/06/2013 at No:-3 office and they have replaced “Speaker” for the same phone and giving to my Client after approx 7-10 days.( Job Sheet No:-4153839995)
D. Fourth time my Client visited again to No:-3 on 01/07/2013 and they have again doing some things and giving to my client.
E. After all harassment my client again visited No:-3 on 06/07/2013( PBA Changed) and they have keep the above said phone with No:-3. ( Job Sheet No:-4154979735) and still phone is with No:-3. Today my client Visited No:-3 office they have offered to change “Mother Board” of the cellphone.My Client has refuse the same.
5. My client states that in view of the defective cell phone sold by No:-4, he suffered a set-back in his profession and excruciating loss and mental agony. My client requested the No:-1 , 2, and 3 of you to replace the defective cell phone with a good piece of cell phone. But you refused to do so.
6. This is a breach of contract and you have provided defective piece to my client.My client states that in view of the defective sale of cell phone, to post to rectify the defects caus-ing serious damage to him, his profession. The No:-1 & 2 of you is liable to replace the defective cell phone with a fresh piece and warranty, besides compensating the damag-es for the hardship and mental agony caused to my client from the date of purchase.
7. My client states that the first and second of you being the manufacturer of the samsung care and the third of you being service center and No:-4 is seller of the defective goods are jointly or severally liable to make good the damages caused to my client.
8. My client hereby calls upon all of you to replace the Samsung cell phone purchased by my client under invoice/bill dated 28/05/2013, with fresh piece of cell phone and pay a sum of Rs. 25,000/- and extra towards compensation for the damages for mental agony and hardship caused to my client from the date of purchase, within a week’s time, fail-ing which my client would be constrained to initiate appropriate proceedings against all of you holding you liable for all costs and consequences arising there from.

Hello Sir,
With reference to above said complaint i would like to share you that i have bought a SAM-SUNG Grand GT-I9082 on 28/05/2013 from M/s. Bhatia Mobile at Surat (Gujarat).

On 01/06/2013 i have observed that my speaker and receiver volume is too slow, so i have vis-ited M/s. Bhatia Mobile and they suggested me to launched a complaint in Samsung Customer Care at Adajanarea , Surat.

Due to unavoidable circumstances i was not able to visit Samsung Service center on immediate basis. I have visited on 08th June, 2013 and Service center has formated my phone and give me, again after 2 days the problem is continue. Again i have visited after 2-3 days and they have againgformated and give me my cell phone.

I must apprecaiate your customer care Manager Mr. Usmanbhai response.

After 2-3 days again i have visited Samsung Service Center and Manager Mr. Usman has changed my Speaker and ensure that the problem has been resolved.

Surprisingly again 2-3 days same things happen during i travelled out of Gujarat. When i came at Surat I met Samsung Manager Mr. Usman he took my cell for a week and changed Speaker / Receiver and other necessary spraes.

But after 3-4 days again same problem continue. I was Travelled so today i again submitted my cell as per your Service Center requirement. Even they are surprised.

This is a high time and i must say that you need to replaced my cell phone on immediate basis , since in a month i have visited 6 times in Samsung Service Center and my cell phone with Ser-vice center more than 8-10 days with Samsung Service Center.

I humbly request you to kindly take the appropriate action and change the cell phone on imme-diate basis. Necessary documents attached for your reference.

Now it’s high time for this complaint resolution.!!!

Surprise to see the resposne with a diplomatic way!!!
When customer is spent Rs.19,000/- and he is not able to using mobile…It is only because of you people!!!!

I have purcahsed the same on 28/05/13 Let’s say approx 40 days back and my mobile is in ser-vice center previously 12+ days. And Now since 06/07/2013…..So i can say that approx 50% days same is with Samsung…

My humble request is to change my cellphone on immediate basis and resolve the same issue by today, otherwise it will forced me to launch the complaint against you in consumer forum.

So I call upon you through this legal notice to replace the handset including the harassment of my client and his overall loss incurred by him due to non absence of phone and his work loss within 15 days from date of receipt of this notice, failing which my client shall have liberty to initiate legal proceedings against your company under competent court of law and in that even-tuality you shall be liable for all costs and expenses which shall be incurred by my client, in this regard A copy of this notice has been kept by me in my office for reference and record.Please note that This notice is issued without prejudiced to you and their charges of Rs.2,500/- will be bared by you only, and you are requested to collect the receipt of this Notice Charges from my Client.
